These Terms govern your use of the Domato PHN portal at phn.domato.ai and any service supplied by Domato AI Pty Ltd ("Domato", "we", "us"). By using the portal, requesting an enquiry, or engaging us for paid work, you agree to these Terms.
The Sydney North portal and the directory landing are provided free of charge for demonstration and evaluation. The portal is built on public data sources (ABS, AIHW, ACARA, DSS, NDIS, ATO, TfNSW) plus methodology we publish on each tool's Methodology section. We make reasonable efforts to keep the data accurate and current, but the portal is provided on an "as is" basis without warranties of any kind.
The portal is a planning and commissioning aid, not a clinical tool. It is not designed for, and must not be used for, decisions about the care of any individual patient.
Source datasets retain their original licences and conditions. Where noted in a tool's Methodology, follow the underlying licence (typically Creative Commons Attribution 4.0 for ABS/AIHW data).
Pricing shown on /demo is indicative. Each paid engagement is governed by a Statement of Work (SOW) signed by both parties. The SOW takes precedence over any inconsistent term on this page.
On full payment of the SOW fees, you own the deliverables produced specifically for your PHN — the catchment portal, branding integration, and any bespoke data pipelines. Domato retains ownership of the underlying templates, design system, and reusable code components that pre-existed or that we use across multiple clients.
Where an engagement involves your internal data (POLAR, PAT-cat, MBS extracts, etc.), we sign your data-sharing agreement before any data is transferred. By default, your data is held only in the engagement-specific Azure subscription, accessible only to named Domato personnel and only for the duration of the engagement plus a 30-day wind-down period unless the SOW specifies otherwise.
Recurring fees (annual refresh / maintenance) buy regular data refreshes on the cadence published by each underlying source plus reasonable bug fixes. They do not buy new features or unscheduled rebuilds; those are scoped separately.
To the maximum extent permitted by Australian law, our liability for any claim arising from your use of the portal or our services is limited to the fees you have paid us in the 12 months preceding the claim. Nothing in these Terms excludes any non-excludable consumer guarantees under the Australian Consumer Law.
Either party may terminate a paid engagement with 30 days' written notice. Fees for work performed up to the termination date remain payable; fees paid in advance for un-performed work will be refunded on a pro-rata basis.
These Terms are governed by the laws of Victoria, Australia. Disputes not resolved through good-faith negotiation will be referred to the courts of Victoria.
